Injured police Cpl David Brown and his family filed for workers’ compensation benefits.  The officer was critically injured after a car hit his motorcycle while escorting a funeral procession.  The ambulance, on the way to the hospital, then turned over, leaving more extensive injuries.

Unfortunately, in the lawsuit, Brown’s duties were “done with permission, knowledge and approval of the City of Montgomery Police Department and were performed for the benefit of the department and citizens of Montgomery.”  Although this is how the police and town are seeing it, Brown’s family says they would like to declare David Brown as an on-duty officer.  The declaration is not possible because David Brown had been working privately under contract with the funeral home.

The family’s personal attorney sent a letter to the city Sept. 30, asking for a review of its position regarding Brown’s workers compensation claim and eligibility. The letter gave the city 10 days to respond.  Brown’s brother said Tuesday that they had not heard back from the city since that time.  If this were to continue, it might have been idea to hire a Jackson personal injury attorney or a lawyer in the area skilled with these types of cases who could help this family with their devastating claim.

Brown was placed on medical disability retirement as of last week and will receive retirement benefits for the rest of his life, Strange said.  The city also has paid for his additional leave time and all other available benefits are being extended to Brown, he said.  Although this workers compensation claim might not be finished, it is a good sign that the family is taking the legal action necessary.
